The agreement, and what Sell a Pen is

These terms are a contract between you and Sparkeit SRL, VAT number RO49625010, registered in Romania, which runs Sell a Pen. Creating an account means you accept them, and our privacy policy is part of them.

Sell a Pen is a text-based coach for cold outreach: it roleplays a buyer, scores your writing line by line, and reviews real outreach before you send it. Four things it is not:

• It never writes your messages. You get marks and scores, never a sentence to paste.
• It is text only. No dialer, no voice practice, no call recording.
• It sends nothing. No automation, no sequences, no access to your inbox or LinkedIn.
• It is coaching, not a promise of results. Nothing guarantees replies or meetings.

Your account

Give accurate details, keep your credentials to yourself, and tell us if someone else gets in. One account, one person, not a team. You must be 16 or over, and authorised to accept these terms for any company you sign up for.

The free tier

Not a trial. Nothing expires and we never ask for a card. Free practises against a fictional product rather than your own, covers levels one to three, allows one session a day, and leaves out review of real messages. Paying lifts all four. We may rate limit an account running automated traffic.

Price and billing

Sell a Pen lists at $39 a month, discounted to $19 as a launch price. The price at checkout is what you are charged, plus VAT where it applies, and Stripe handles the payment. It renews monthly until you cancel, and a failed payment may be retried, with access suspended until it clears. Price changes reach your renewal only after 30 days notice by email.

Refunds and cancelling

If it is not working for you, email contact@sellapen.com within 14 days of a charge and we refund it. No conditions, no form. One person reads that inbox, so allow five working days from your email for the refund to go back through Stripe. If you signed up as a consumer rather than for a business, you also have a statutory 14 day right of withdrawal under EU law: using paid features in that window means asking us to begin immediately, so staying on the free tier keeps the right intact.

To cancel, email contact@sellapen.com and we stop the renewal, or use the cancel control in your account settings wherever the app offers one. Either way you keep access to the end of the period you paid for.

Acceptable use

Do not use Sell a Pen for outreach that is unlawful, harassing, discriminatory or deceptive, or to break the rules that apply to it, including the GDPR and the ePrivacy rules on unsolicited messages. Do not upload personal data about other people beyond what the coaching needs; redact names. Do not resell or share access, scrape the service, flood it with automated requests, extract the prompts behind it, or probe its security. We can close an account that breaks these rules.

Your content, and the AI output

Your drafts, sessions and business context stay yours. You grant us a limited licence to store, process and transmit them only to run the service, including sending them to our AI provider, and it ends when you delete them. Your text is not used to train AI models: the detail is in where your text goes.

One planned feature goes slightly further than running the service, and it is opt-in and off by default: if you tell us whether a message got a reply, that answer may be counted alongside other people’s answers to check whether the habits the coach marks down actually cost replies. Counts only, never your text and nothing that identifies you or your recipient, and nothing at all unless you switch it on.

The scores and feedback come from an AI model. It can be confidently wrong. Treat it as one opinion, not fact or legal advice. You decide what you send, and you are responsible for it, including the law where your recipient is.

The legal minimum: warranties, liability and ending it

The service is provided as is. We rely on third parties for hosting, authentication, payments and the AI model, so we cannot promise it is uninterrupted, and we exclude other warranties as far as the law allows. Nothing limits liability the law says cannot be limited. Beyond that we are not liable for lost profits, deals or data, and our liability is capped at what you paid us in the 12 months before a claim. Consumers keep their statutory rights.

We can end an account for a serious or repeated breach, or if we stop offering the service, with notice and a refund of the unused period. The law of Romania governs, though an EU consumer keeps their home protections and courts. Material changes get 30 days notice by email.
